YachtNest – Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of the YachtNest mobile application and related services (the “App”) operated by Sve na svitu d.o.o. (“we,” “us” or “our”), with registered office at Mažuranićevo šetalište 30, 21000 Split, Croatia, VAT (OIB) 36362643039. By downloading, installing or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Definitions

App means the YachtNest mobile application and any related websites or APIs.

User means any person who registers for or uses the App.

Client means a User who requests services or supplies via the App.

Supplier means a User who offers goods or services via the App.

Admin means a User with elevated privileges authorized by us.

Services means any goods, supplies, chat or bookings facilitated through the App.

Order means a request placed by a Client with a Supplier via the App.

2. Eligibility & Account Registration

You must be at least 16 years old and legally capable of entering contracts.
To use the App you must register an account and provide accurate, current information.
You are responsible for keeping your login credentials secure and for all activity under your account.

3. License Grant

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable license to install and use the App.
You may not reverse-engineer, decompile or modify the App.
You may not remove proprietary notices or alter the App’s code.

4. User Conduct & Obligations

Clients agree to pay all amounts due to Suppliers for completed Orders.
Suppliers agree to deliver Services as described in accepted Orders.
All Users must comply with applicable laws and these Terms.

5. Orders, Pricing & Payment

All Service prices, fees and payment terms appear in the App at the time of Order.
Payments are processed via In-App Purchases or third-party processors as indicated.
Clients are responsible for any taxes arising from Orders.
Refunds are subject to the policies of the payment processor and Supplier’s refund terms.

6. Privacy

Your use of the App is governed by our Privacy Policy, available at https://yourdomain/privacy

7. Intellectual Property

All App content—text, graphics, logos, code, images—is owned by Sve na svitu d.o.o. or its licensors.

Protected by copyright, trademark and other laws.

You may not use any of our trademarks or branding without written permission.

8. Disclaimers & No Warranty

The App and Services are provided “as is” and “as available.” We disclaim all warranties, express, implied or statutory.

9. Limitation of Liability

Under no circumstances shall Sve na svitu d.o.o. be liable for any indirect, incidental, special or consequential damages.

Our total liability for any claim under these Terms shall not exceed €100.

10. Indemnification

You agree to indemnify and hold harmless Sve na svitu d.o.o. from any claim arising out of your breach of these Terms.

11. Termination

We may suspend or terminate your account at any time for any reason. Upon termination, your right to use the App immediately ceases.

12. Changes to Terms

We may revise these Terms at any time. Your continued use constitutes acceptance of the revised Terms.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of Croatia. Any dispute shall be resolved in the courts of Split, Croatia.
